The rules for renewing the temporary residence of foreigners are enshrined in the Act on the Residence of Foreigners.
The application for the renewal of temporary residence is submitted by the national of a third country in person on an official form at the police department no later than on the last day of validity of the temporary residence. The application for the renewal of temporary residence for the purpose of seasonal work is submitted by the national of a third country in person on an official form at the police department no later than 30 days before the expiration of the validity of the granted temporary residence. When applying for the renewal of temporary residence, the national of a third country is obliged to submit a valid travel document, otherwise the police department will not accept the application. The police department will issue a confirmation of its acceptance to the applicant on the day the application is submitted.
What must be attached to the application for renewal of temporary residence
To the application for renewal of temporary residence, the national of a third country is obliged to attach one photo with dimensions of 3 x 3.5 cm showing his current appearance and documents not older than 90 days, which confirm
a) purpose of stay; this does not apply if the facts proven by a document according to § 32 par. 5 remained unchanged,
b) financial security of stay; this does not apply if it is a national of a third country according to § 22 par. 1 letter a), 28 or § 29,
c) health insurance during the stay in the territory of the Slovak Republic; this does not apply if it is a national of a third country according to § 23, 24 or § 30 par. 1 letter b) and c),
d) provision of accommodation; this does not apply if it is about
- a national of a third country who regularly commutes to work or to school across the state border from a neighboring state,
- a national of a third country who has been granted temporary residence pursuant to § 24 and is studying at a university,
- a national of a third country who has been granted temporary residence pursuant to § 26 or § 29,
- a national of a third country who represents or works for a significant foreign investor in the Slovak Republic, his spouse and child or
- of a national of a third country who has been granted temporary residence pursuant to § 25 par. 1 letter d) or § 25 par. 1 letter h) and performs voluntary service in the European Voluntary Service,
e) the feasibility and sustainability of the business activity, if it concerns a national of a third country who has been granted temporary residence pursuant to § 22 and the business company or cooperative on whose behalf he acts did not achieve a profit after taxation in accordance with paragraph 7 in the previous tax period.
The police department when renewing residence pursuant to § 23 par. 1 shall request in writing from the competent office of labor, social affairs and family a confirmation of the possibility of filling a vacant position. The police department shall attach a copy of the part of the request for renewal of residence, which contains the applicant's personal data, and a copy of the documents proving the purpose of the stay to the request for the issuance of a confirmation according to the previous sentence.
Conditions for renewal of temporary residence for the purpose of doing business
A citizen of a third country who has been granted temporary residence for the purpose of business may not have registered arrears with the tax office, customs office, registered arrears of social insurance premiums, and the health insurance company does not register claims against him as of the date of submission of the application for renewal of temporary residence for the purpose of business after maturity according to special regulations from this business and from all commercial companies and cooperatives in whose name it acts. If the national of a third country is not a taxpayer or is not obliged to pay social insurance premiums, he shall attach a document confirming this fact.
A citizen of a third country is obliged to prove the taxed income from this business for the previous tax period in the amount of at least twenty times the subsistence minimum when applying for the renewal of temporary residence for the purpose of business; if he did not do business during the entire previous tax period, he is obliged to prove a taxed income in the amount of twice the subsistence minimum for each month of stay in the previous tax period. If the national of a third country was not yet authorized to do business in the previous tax period, he is obliged to prove the financial security of the business activity in the amount of ten times the subsistence minimum by confirming the balance in the account when applying for the renewal of temporary residence.
When applying for the renewal of temporary residence for the purpose of business, a national of a third country is obliged to prove the profit after taxation of the business company or cooperative on whose behalf he acts for the previous tax period at least in the amount of sixty times the subsistence minimum, if he is a national of a third country whose business intention was assessed by the Ministry of Economy of the Slovak Republic as an innovative project, at least in the amount of twenty times the subsistence minimum; if he did not do business for the entire previous tax period, he is obliged to prove a profit after tax in the amount of five times the subsistence minimum for each month of stay in the previous tax period. If a national of a third country acts on behalf of several commercial companies or cooperatives, the condition of the amount of profit after taxation according to the previous sentence must be met by at least one commercial company or cooperative on behalf of which he acts. If a national of a third country was not yet authorized to act on behalf of a business company or a cooperative in the previous tax period, he is obliged to prove financial security of business activity in the amount of thirty times the subsistence minimum by confirming the balance in the account when applying for the renewal of temporary residence.
For what period is the renewal of residence issued
The police department can renew temporary residence:
- seasonal work - at most for a period that, together with the previously granted temporary residence and residence, does not exceed 180 days during 12 consecutive months and the completion of seasonal work requires another stay,
- study and research development - for nine months, if it is a national of a third country who, after finishing his studies or research activity, wants to stay in the territory of the Slovak Republic with the aim of looking for a job or starting a business,
- for a maximum of three years, if the expected stay of a national of a third country will last at least three years,
- for a maximum of five years, if it is a national of a third country according to § 23, 24 or § 27, if the expected stay of a national of a third country will last at least five years, or
- for a maximum of five years, if it is a national of a third country according to § 29 or § 30.
