A citizen of the European Union has the right of residence for a period of 3 months after entering the territory of the Slovak Republic - holder of a valid identity card or travel document - without any other conditions or formalities. He only has the obligation to report the beginning of his stay at the relevant foreign police department of the Police Force within 10 working days of entering the territory of the Slovak Republic.
Reporting the stay of a foreigner after entering the territory of the Slovak Republic
- has secured accommodation in an accommodation facility – the obligation to report the stay has an accommodation facility (hotel, hostel, boarding house...)
- has secured private accommodation - the foreigner has the obligation to report his stay at the relevant department of the Foreigners' Police, PZ according to his address of residence in the territory of the Slovak Republic.
The accommodation facility or the foreigner fills out the appropriate "Residence report" form and arranges for its handover/delivery to the relevant department of the foreigner's police.
If the citizen of the Union stays in the territory of the Slovak Republic for longer than 3 months, it is mandatory to register the residence of the citizen of the Union in person at the relevant foreign police department of the Police Force, registration of the residence is free of charge, the deadline for registration of the residence is no later than 30 days from the expiration of three months from the day of entry into the territory of the Slovak Republic of the Republic.
Pursuant to the Act on the Residence of Foreigners, a citizen of the Union is:
- a citizen of another EU member state except the Slovak Republic,
- a citizen of a state that is a contracting party to the Agreement on the European Economic Area (EEA), a
- citizen of Switzerland
An EU citizen has the right to stay on the territory of the Slovak Republic for a period longer than three months, if:
- is employed in Slovakia,
- is a self-employed person in Slovakia,
- is studying at a primary, secondary or university in Slovakia,
- has sufficient resources for himself and his family members so that they do not become a burden on the social assistance system during their stay and health insurance in Slovakia,
- it is assumed that he will be employed,
- is a family member of an EU citizen whom he accompanies or joins and who meets at least one of the conditions above.
Stay of a family member of an EU citizen
A family member of an EU citizen (guarantor) is a citizen of a non-EU country who is
- his husband
- his child under the age of 21, his dependent child and such child of his spouse,
- his dependent direct relative in the descending or ascending line and such person of his spouse,
- any other family member who is not covered by letters a) to c) and is a dependent person in the country from which he comes, or is a member of his household, or is dependent on his care for serious health reasons,
- his partner, with whom the EU citizen has a permanent, properly proven relationship,
a citizen of a non-EU country with the right of residence in the same member state in which the EU citizen has the right of residence and the EU citizen is a citizen of the Slovak Republic with whom the citizen of a non-EU country returns to stay or joins him for a stay back on the territory of the Slovak Republic and meets any of the conditions listed in letters a) to e) in relation to a citizen of the Slovak Republic.
STAY REPORT
A family member of an EU citizen is obliged to report the start and place of his stay to the foreign police according to his place of residence within 10 working days from the day of entry to the territory of Slovakia, using the Declaration of stay form, if the accommodation provider (hotel, hostel) does not do it for him.
