An EU citizen can be employed on the territory of the Slovak Republic without the need to obtain a work or other permit. EU citizen means a citizen of an EU member state except the Slovak Republic; a state that is a party to the Agreement on the European Economic Area (EEA) and Switzerland.
Obligations of the employer
- If you employ an EU citizen, you have the obligation to submit an information card on the establishment of an employment relationship to the relevant office of labor, social affairs and family within 7 working days of the worker's starting employment.
- If the employment of an EU citizen has been terminated, as an employer you are obliged to submit an information card on the termination of the employment relationship to the relevant office of labor, social affairs and family within 7 working days from the termination of employment.
- The competent office of labor, social affairs and family is the office in whose territorial district the EU citizen will be employed.
Information card
The form that the employer is obliged to submit is called the INFORMATION CARD on the establishment of the employment relationship / on the start of the secondment for the performance of work1) of the EU citizen.
The information card is submitted to the relevant labor office in whose territorial district the third-country national will be employed (ie the place of employment is decisive, not the employer's seat) at the earliest on the day of employment and at the latest within seven working days from the date of employment of such a worker. For each current place of work, this Information Card form should be submitted to the relevant office according to the place of work.
After registering the Information Card, the Labor Office sends a "Confirmation of Receipt of the Information Card" to the employer's electronic mailbox. The employer records the said confirmation as a document for control purposes of the labor office or labor inspection. By accepting the information card form, the labor office does not confirm the correctness of the filled-in data and does not confirm that the employer has fulfilled the conditions according to Act no. 5/2004 Coll. on employment services and Act no. 82/2005 Coll. on illegal work and illegal employment.
The information card can be sent electronically using the form published on the slovensko.sk portal or in writing (by mail or in person). There is no charge for sending the Information Card.
An electronic identity card (eID) is required for sending. When sending, electronic signature of the Information Card with a qualified electronic signature is required (without a signature, the Information Card cannot be sent).
Residence of an EU citizen in Slovakia
An EU citizen has the right to stay on the territory of the Slovak Republic for a period longer than three months, if:
- is employed in Slovakia,
- is a self-employed person in Slovakia,
- is studying at a primary, secondary or university in Slovakia,
- has sufficient resources for himself and his family members so that they do not become a burden on the social assistance system during their stay and health insurance in Slovakia,
- it is assumed that he will be employed,
- is a family member of an EU citizen whom he accompanies or joins and who meets at least one of the conditions above.
An EU citizen is obliged to report the beginning and place of his stay to the foreign police according to his place of residence within 10 working days from the day of his entry into the territory of Slovakia, using the Declaration of Residence form, if the accommodation provider (hotel, hostel) does not do it for him.
An EU citizen who is staying in Slovakia for more than three months is obliged to apply for residence registration within 30 days from the expiration of three months from the day of entry into the territory of the Slovak Republic.
